1. VALIDITY OF GENERAL TERMS AND CONDITIONS

The following Terms and Conditions shall apply to all services provided by CONSORTIO VIETNAM JOINT STOCK COMPANY in connection with the reselling of prepaid physical SIM and eSIM cards, hereafter referred to as Way2Go.

The Terms and Conditions can be found on the website https://www.way2go.vn.

Way2Go may accept different clauses only if explicitly agreed upon in writing.

2. DESCRIPTION OF SERVICES

2.1. SIM RESELLING

Way2Go resells prepaid physical SIM and eSIM cards.

The Customer can register and purchase SIM cards on the Way2Go website: https://www.way2go.com. Payments are processed by Onepay (https://onepay.vn) and PayPal (https://paypal.com) using a virtual credit card imprint (alias of your credit card).

2.2. REGISTRATION FOR USING WAY2GO SERVICES

To use Way2Go services, the Customer must accept the General Terms and Conditions. The Customer can provide the required information directly or through a service provider on the web browser at https://www.way2go.vnor https://www.registration.way2go.vn, as requested by the mobile network operator.

2.3. WAY2GO OBLIGATIONS

Way2Go will make reasonable efforts to provide Customers with quality service. However, Way2Go does not guarantee uninterrupted service, timely delivery, or complete safety and error-free performance.

2.4. CUSTOMER OBLIGATIONS

When using the equipment or services provided by Way2Go, the Customer must not engage in any actions that are abusive, illegal, or fraudulent or that impair or damage the network.

If the Customer breaches their obligations under Section 2.4, Way2Go may suspend the Customer's use of the service. During any period of suspension, the Customer must continue to pay all charges due under this agreement for the suspended services.

2.5. DEVICE COMPATIBILITY

The Customer is responsible for ensuring that their device is compatible and network-unlocked. Device compatibility may vary depending on the carrier and country of origin, so the Customer should check the list of SIM-compatible devices provided at checkout.

By checking the box confirming their device's SIM compatibility, the Customer assumes responsibility for the accuracy of the information they provide.

The SIM compatibility list is not exhaustive, meaning that newly announced SIM-compatible devices may need to be added. To ensure your device is compatible, contact Way2Go's support team via the Contact Us page or email [email protected].

3. START, DURATION, AND TERMINATION OF THE CONTRACT

The service contract between Way2Go and the Customer begins upon completion of the order on the Way2Go website: https://www.way2go.vn.

The Activation of the SIM and acknowledgment of the Activation Policy is the Customer's responsibility.

The contract will be terminated if the Customer does not have an active data package, lacks a physical SIM card, or deletes the eSIM from the target device.

4. CHARGES AND PAYMENT

4.1. PAYMENT CONDITIONS

Way2Go supports payments through credit/debit cards and PayPal.

All payments are made in Vietnamese Dong (VND).

Credit card transactions are processed and secured by Way2Go providers Onepay (https://onepay.vn) and PayPal (https://paypal.com).

4.2. CHARGES FOR USE

4.2.1. Unless otherwise specified, all charges stated by Way2Go include VAT.

4.2.2. The Customer shall not be entitled to offset any claims against Way2Go's claims, except where the Customer's claims are undisputed or have been confirmed by a final court judgment.

5. DELIVERY

After purchasing, the Customer will immediately see the purchased SIM under the "My SIMs" tab on the Way2Go website https://www.way2go.vn. A confirmation email will be sent to the Customer following the purchase. All information for receiving the physical SIM and installing the eSIM will be available only through email and the Customer's Way2Go account.

6. REFUND / CANCELLATION / MODIFICATION POLICY

The Customer has the right to request a refund or replacement if the SIM cannot be installed or used due to a technical issue caused by Way2Go.

6.1. REFUNDS AND CANCELLATIONS

6.1.1. POLICIES AND GUIDELINES

6.1.2. A refund request can be made within thirty (30) days from the date of purchase if activation is not possible after extensive collaborative troubleshooting.

6.1.3. Prompt cooperation with the Customer to resolve the issue is required for a refund to be granted.

6.1.4. Each data package has a specific validity period. No refund will be offered for remaining data once the validity period expires.

6.1.5. Compensation: No refund or remuneration will be issued for charges from alternative phones, SIM cards, providers, hotel phones, or other charges not directly linked to the Customer's Way2Go SIM account. (Refer to section 7: LIABILITY AND WARRANTY in our Terms and Conditions.)

6.1.6. Fraudulent purchases: Way2Go reserves the right to refuse any refund request if there is evidence of abuse, violation of our Terms and Conditions, or fraudulent activity connected with using Way2Go products and services.

6.1.7. Unauthorized purchases: The case will be subject to investigation and approval before processing any refund. Way2Go reserves the right to suspend any account associated with fraudulent activity.

6.1.8. Accidental purchases: Once Customers insert the physical SIM or install the eSIM, it will be considered used, and no refunds will be offered.

6.1.9. Incorrect charges: If the Customer reasonably disputes an invoice or part of it in good faith, the Customer must notify Way2Go of the dispute within seven (7) days of receipt of the invoice, providing details of why the invoiced amount is incorrect and, if possible, how much the Customer believes is due. (See section 4.2: CHARGES FOR USE under Terms and Conditions.)

6.1.10. Other reasons: If the refund request does not fall within the categories above, we will investigate the request on a case-by-case basis. If the refund is approved, a processing fee may apply. The maximum refund or credit a Customer can apply for must be equal to or less than the total amount paid.

6.1.11. REFUND PROCESS

To request a refund, contact Way2Go's support team via the Contact Us page or email [email protected]. Our refund policy will apply. Depending on the nature of the issue, Customers may be asked to provide additional information to support their refund request, such as screenshots of device settings for technical issues or details on why the invoiced amount is incorrect and, if possible, how much the Customer believes is due, etc.

Please refer to section 6.1.2 in this document for refunds related to technical issues.

Customers can choose to receive the refund back to their original payment method or as cash at Way2Go pick-up points.

Refund to the original method: Once a refund is approved and issued, it may take up to ninety (90) business days to appear on a statement depending on the bank.

Cash: Once a refund is approved and issued, Customers can choose a Way2Go pick-up point and receive the refund at the selected location.

6.2. MODIFICATION

Way2Go's SIM data packages are offered as-is and cannot be modified or customized based on individual requests once purchased.

7. LIABILITY AND WARRANTY

Way2Go is not responsible for any detriments arising from the proposed service not being constantly available. Way2Go does not guarantee constant availability of the network service. For any inquiries or support, please email [email protected].
